{"id":4880,"date":"2012-01-12T10:19:59","date_gmt":"2012-01-12T15:19:59","guid":{"rendered":"http:\/\/neanderpundit.com\/?p=4880"},"modified":"2012-01-12T10:19:59","modified_gmt":"2012-01-12T15:19:59","slug":"first-amendment-blues-for-the-obangi-justice-department","status":"publish","type":"post","link":"https:\/\/neanderpundit.com\/?p=4880","title":{"rendered":"First Amendment blues for the Obangi justice department."},"content":{"rendered":"<p>Apparently the Justice department thinks it can tell churches what to do where <a href=\"http:\/\/www.supremecourt.gov\/opinions\/11pdf\/10-553.pdf\">hiring is concerned<\/a>, and the supremes unanimously (yes, even including Kagan)  tell them to <a href=\"http:\/\/www.nationalreview.com\/corner\/287844\/lost-politics-big-win-religious-liberty-supreme-court-david-french\">piss up a rope.<\/a> <\/p>\n<p>I&#8217;m very impressed by this; the first amendment makes it very clear that this is not the business of the government. Apparently even the <a href=\"http:\/\/www.nytimes.com\/2012\/01\/12\/us\/supreme-court-recognizes-religious-exception-to-job-discrimination-laws.html?_r=1&#038;ref=todayspaper\">Liberal Deathstar<\/a> reported on this, though the lede actually emphasised the &#8216;Ministerial exception&#8221; as though the court granted a special dispensation just this once. Bullshit, NYT. this is not an exception, it&#8217;s the law of the land. I&#8217;m surprised they did this, but it was, at least, the right thing to do. The first is about the free exercise of religion, it isn&#8217;t a guaranteeof freedom from religion for people. Justice dpartment telling a church who they can and who they can&#8217;t hire? Just as stupid as calling two men or two women &#8220;Married&#8221;. It&#8217;s not about that at all, of course, it&#8217;s a wedge. A toe in the door. Let this slip and the next thing you know Churches are as relevant as Kodak film.<\/p>\n<p>Of course that&#8217;s what quite a lot of people want.
